At RESTART CBD + THC, we believe education is empowerment—especially when it comes to understanding the legal landscape of hemp-derived cannabinoids across the United States. As a Texas-based, family-owned brand rooted in transparency and trust, we’re committed to helping our customers navigate what’s legal and where, so you can confidently shop, travel, and consume with peace of mind.

From Delta-8 and Delta-9 to THCa flower, vapes, and infused beverages, hemp laws vary dramatically from state to state—and they’re changing fast. That’s why we’re breaking it all down for you: what’s allowed, what’s not, and what’s coming next.

Whether you’re a longtime RESTART customer or new to the world of hemp-derived wellness, this guide is your go-to resource to stay compliant and informed—wherever you are in the country.

  • Adult-use cannabis has been fully legal since July 1, 2021, with regulated sales following shortly after.

  • Hemp-derived products are still generally permitted—but only within narrowly defined THC limits. As of January 1, 2025, hemp products must fall under the “Moderate‑THC Hemp” category to be sold, which imposes very low allowable THC thresholds and requires a special registration or license for vendors.

  • Infused beverages are explicitly allowed but tightly controlled: only certain licensed entities may produce and sell them, with dosage and distribution strictly regulated since October 1, 2024.

  • Enforcement is ramping up: the AG’s office has enhanced authority over illegal cannabis and vape sales, and retailers have opposed the new hemp THC rules via litigation.
