SB3 Legislative Timeline
March 19, 2025 – Senate Approval
SB3 passed the Texas Senate with a 25-6 vote, aiming to ban all consumable hemp products containing THC, including Delta-8 and Delta-9 variants.
April 7, 2025 – House Committee Hearing
The House State Affairs Committee conducted a public hearing on SB3, where numerous small business owners, veterans, and industry advocates voiced their opposition.
May 20, 2025 – Second Reading in the House
SB3 was placed on the Major State Calendar and read for the second time in the House.
May 21, 2025 – House Amendments and Passage
After several amendments, the House passed SB3 which reinstated the orginal form of SB3, not taking on any committee substitutes. The bill passed with a 95-44 vote, moving it closer to becoming law.
May 25, 2025 – Final Senate Concurrence
The Senate concurred with the House amendments, finalizing the legislative process and sending SB3 to Governor Greg Abbott for consideration.
Implications of SB3
If signed into law, SB3 would:
Ban all consumable hemp-derived THC, CBN, CBC, THCV, and other cannabinoid (excluding CBD & CBG) products, including edibles, beverages, and vapes.
Criminalize possession of any THC-containing hemp product, with penalties up to one year in jail (even more for retailers and manufacturers if they are caught selling these items).
Threaten the livelihood of over 50,000 Texans employed in the hemp industry and jeopardize approximately 8,000 businesses statewide.
