Delta-9 vapes are legal in certain states where cannabis has been legalized for recreational or medical use. Federally, products with more than 0.3% Delta-9 THC are still considered illegal in the U.S
THCa vapes are technically legal to purchase and possess as long as they are derived from hemp and contain less than 0.3% Delta-9 THC, according to federal law. This is based on the 2018 Farm Bill, which legalized hemp and its derivatives meeting these criteria. However, some states have specifically banned THCA, so it's important to check local regulations before purchasing Law Enforcement: Police may have difficulty distinguishing between THCa and THC products, leading to potential seizures and charges. While THCa vapes are technically legal, the risks associated with possession and use are high due to the conversion to THC upon heating and the limitations of current testing methods.
